RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO NEGOTIATE AND EXECUTE AN AMENDMENT TO A PROFESSIONAL SERVICES CONTRACT WITH THE FRIENDS OF OAKLAND PARKS AND RECREATION FOR ADMINISTRATIVE SUPPORT SERVICES ASSOCIATED WITH THE MEASURE DD COMMUNITY COALITION IN AN AMOUNT NOT TO EXCEED $23,752, FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED $39, 751

WHEREAS, the Measure DD Implementation staff report approved by City Council on July 15, 2003 recognizes and supports the formation of a Measure DD community Coalition organization; and

WHEREAS, the City Council agreed to provide funding towards the administrative support of the Measure DD Community Coalition: and

WHEREAS, the City with assistance from the Measure DD Community Coalition solicited and reviewed written proposals from interested non-profit organizations and individuals to provide administrative support services retained the services of Friends of Oakland Parks and Recreation to provide administrative support; and

WHEREAS, funding is available and budgeted for these services from the Measure DD Capital Improvement – Clean Water, Safe Parks Fund (Fund 5320), City Planning-Other (Organization 88229), Measure DD Administration (Project C241510); and

WHEREAS, THE City wishes to amend the professional services contract with the Friends of Oakland Parks and Recreation to continue to provide administrative support services at the rate of $1250 per month through July 2006, the completion date for Series A of Measure DD, by increasing the current contract amount from $14,999 by $23,752, to a total contract amount not to exceed $39,751; and

WHEREAS, the City Council finds that the Friends of Oakland Parks and Recreation offers a specialized service in working with community groups and public agencies to facilitate communications and that the consultant services authorized hereunder are of a professional, scientific, or technical nature and are temporary in nature; and

WHEREAS, the City Council finds and determines that the contracts authorized hereunder will not result in the loss of employment or salary by any person having permanent status in the competitive services; now, therefore be it

RESOLVED: that the City Administrator or her designee, is hereby authorized to negotiate and execute an amendment to the professional services contract with the Friends of Oakland Parks and Recreation in an amount not to exceed $23,752, to a total contract amount not to exceed $39,751; and be it

FURTHER RESOLVED: That the City Administrator, or her designee, is hereby authorized and empowered to execute in the name of the City of Oakland all necessary contracts, payment requests, agreements and amendments hereto for the purposes of the professional services agreement; and be it

FURTHER RESOLVED: That the City Attorney’s Office has reviewed this resolution as to form and legality and a copy is kept on file with the City Clerk.
